Watt-Bell, Introduction, 29).
Arbitration (631 words)
An arrangement by which two or more persons, having a difference, appoint someone to hear and settle their dispute and to abide by that decision. Arbitration appears in the Qurʾān several times. The Arabic equivalent, used only in the singular, is ḥukm, a verbal noun of ḥakama. The root ḥ-k-m, which is said to be of non-Arabic origin (Jeffery, For. vocab., 111), has a number of meanings (see foreign vocabulary). The principal meanings of the simple verbal form ḥakama are "to govern, " "to restrain, " «to pass judgment» and «to be sage.» From these original meanings ḥākim, "he who decides, the authority, governor, judge, wise, " and ḥukm, "order, rule, sentence, judgment, wisdom, " are derived (q 5:46-9; 6:56; 12:39; 18:25; 26:82). Ḥakam, "arbiter, " appears twice in the Qurʾān. One verse enjoins the appointment of an arbiter in the case of marital disputes: «If you fear a split between a man and his wife, send for an arbiter from his family and an arbiter from her family. If both want to be reconciled, God will adjust things between them. For God has full knowledge, and is acquainted with all things» (q 4:35). The other is «Shall I seek an arbiter other than God, when he it is who has sent you the book, explained in detail?» (q 6:114).¶ The appointment of arbiters, like a number of other practices of the Islamic community, is of pre-Islamic origin. In the Mecca of Muḥammad’s day, it was customary for the parties in a dispute to select their own arbiter, usually a man noted for his tact, wisdom and knowledge of ancestral custom. Very often the disputing parties referred their case to a soothsayer (kāhin, see soothsayers), a practice the Qurʾān specifically denounces (q 52:29; 69:42). Ultimately, the Qurʾān stresses that final judgment belongs to God alone (q 6:57, 62; 12:40; see last judgment) and «the Arbiter» (al- ḥakam) is one of his titles (see god and his attributes). It is he who conferred the authority to make decisions on his prophets (q 21:78-9). As long as Muḥammad was alive, he was naturally regarded as the ideal person to settle disputes and was elevated to the position of judge supreme. His functions and responsibilities in Medina are defined in terms of qurʾānic decrees: «We have sent down to you the Book (q.v.) with the truth in order that you may judge (li-taḥkuma) between the people on the basis of what God has shown you» (q 4:105). Muḥammad distinguished himself from soothsayers by basing his judgments upon scripture. Muḥammad is told that if Jews come to him seeking arbitration and he accepts, «Judge (faḥkum) between them fairly» (q 5:42; see Watt-Bell, Introduction, 29). The Prophet left Mecca for the purpose of acting as an arbiter between the feuding tribes in Medina (see emigration). His role as the messenger (q.v.) of God apparently suggested that he was a man of superior wisdom (Watt, Islamic political thought, 21). Later generations ascribed to Muḥammad a great number of legal decisions which, coupled with the existing customary law, formed the basis of Islamic law. See also judgment; law and the qurʾān.¶ |

Arbitration (2,570 words)
Arbitration is a conflict-resolution method different from adjudication, but nevertheless with a long history in Islamic law. In principle, it takes place outside the courts and is voluntary. Parties to a dispute agree to defer to one or many persons—the arbiters or arbitrators—by whose decision they both have agreed to be bound. Two Arabic words are frequently used to refer to arbitration. The first, taḥkīm, derived from the root ḥkm, refers to the intervention of a third person, the arbiter (ḥakam or muḥakkam), who is called upon by the litigants to intervene in their dispute and to issue a decision that the litigants have agreed to consider as binding. This root occurs 209 times in the Qurʾān, in 14 forms. As a second-form verb (ḥakkama), it has the factitive sense of «making someone judge» or «entrusting someone with judgement.» The verb appears in Q 4:65: «but no, by your Lord, they will not believe until they make you the judge [yuḥakkimūka] in what has broken out between them.» In Islamic tradition and history, the noun taḥkīm evokes the arbitration that took place in 37-8/658 between ʿAlī b. Abī Ṭālib, the fourth of the Rightly Guided caliphs, and Muʿāwiya b. Abī Sufyān, the soon-to-be first Umayyad caliph. Following many battles and skirmishes, the two opponents had agreed to cease fighting and to refer the dispute to arbitration. ʿAmr b. al-ʿĀṣ was entrusted by Muʿāwiya to be his arbiter, while Abū Mūsā l-Ashʿarī was designated by ʿAlī, under pressure from the qurrāʾ (readers of the Qurʾān) faction. ʿAmr succeeded in drawing al-Ashʿarī into undermining ʿAlī and accepting the removal from power of both adversaries, while he himself continued to support his own candidate. ʿAlī rejected the decision and the war resumed until his assassination by the Khārijī (secessionist) Ibn Muljam, in Kūfa on 17 Ramadān 40/24 January 661. The second Arabic term used to refer to arbitration, ṣulḥ, is related to the verb ṣalaḥa, which denotes the idea of reconciliation. In the Qurʾān, it has the meaning of peaceful and/or negotiated settlement. The term appears in Q 4:128: «and if a wife fears highhandedness or alienation on her husband’s part, neither of them will be faulted if they agree between themselves on a settlement.» This word has a strong positive, moral connotation, as it refers to righteousness. The fourth-form verbal noun (iṣlāḥ) has the meaning of bringing order (and thus reforming) through reconciliation, as in Q 7:56: «do not spread corruption on earth after it has been set right.» Both terms—taḥkīm and ṣulḥ—are treated in Islamic legal doctrine (fiqh). Scholarly definitions converge on taḥkīm as the «process whereby the disputing parties agree to appoint someone to act as an arbitrator of the issue in dispute between them» (Zahraa and Hak, 3-4). It is the Islam-compatible version of a concept that existed in pre-Islamic times, when tribes of the Arabian Peninsula were known for resorting to taḥkīm to resolve disputes. The Prophet himself was appointed as an arbiter on many occasions, including when, while still in Mecca, he was invited by the people of Yathrib (later Medina) to settle the feuds between the Arab tribes and Jewish clans. The Companions of the Prophet and the first caliphs frequently recommended and used this method of conflict resolution. Therefore, taḥkīm can be considered an Islamic institution consensually approved of by Muslim scholars. The jurists specify a number of essential elements and conditions required for a valid process of taḥkīm. First, the disputing parties must agree on settling their argument by way of arbitration instead of adjudication; on the designation of the arbiter or the arbitration committee; and on the procedure that must be followed until the issuing of the decision. Second, the disputing parties (muḥakkimūn) must decide voluntarily to resort to an arbiter in order to resolve the conflict. Third, they must appoint one person (muḥakkam), or many people, to be granted authority to settle their dispute. Arbiters must have certain qualifications, but the different schools of law (madhāhib) diverge as to whether or not they must possess the same qualifications as judges (quḍāt). Notwithstanding these controversies, it is generally agreed that an arbiter must be a Muslim, have a sound mind and full capacity, be male, be just and trustworthy, and be competent in Islamic doctrine. Fourth, there must be an explicit oral agreement by the parties to the decision to engage in an arbitration process. This agreement is called ṣīgha, the pronouncement made by the disputing parties to the arbiter they have designated, and it creates a legally binding relationship. Fifth, the question submitted to arbitration must be one that can be resolved legitimately by arbitration. The majority of Muslim scholars consider taḥkīm as limited to matters concerning individual rights (ḥuqūq al-nās). According to the Ḥanafī school, all matters that can be settled by ṣulḥ can be equally settled by taḥkīm, a stipulation that would exclude qiṣāṣ (full retaliation for murder or grave injury) and ḥudūd (penalties stipulated by the Qurʾān) but not diya (blood money). And sixth, the arbiter must issue a valid decision (ḥukm), which means principally that it must be in accordance with Sharīʿa and issued at a time when the consent of the parties is still valid. The decision must be written and witnessed by a righteous person. While the majority of Muslim scholars consider an arbitration decision to be unchallengeable, there are scholars who argue that it may be referred to a judge (qāḍī) for confirmation. Taḥkīm is terminated by one of the parties’ withdrawal of consent before the issuing of the decision, the pronouncement of the decision, or the passing of time, if a certain period was stipulated. Corruption, mistakes, and fraud are also causes for nullification of the procedure or the decision. Ṣulḥ is also treated in fiqḥ. It can be defined as «a contractual obligation that requires one or both parties to concede certain of their rights» (Hallaq, 269). Its origins can be traced to pre-Islamic times, when privately undertaken justice predominated. A famous poem (muʿallaqa) by Zuhayr b. Abī Sulmā mentions the case of a mediator who offered compensation from his own pocket in order to persuade the litigants to stop their feud and seek conciliation (Othman, 66). An Arabic maxim states that «conciliation is the most honorable decision» (al-ṣulḥ sayyid al-aḥkām). The Qurʾān and Prophetic Tradition (Sunna) laud the role of mediators and uphold the value of compromise. The Prophet was said to have favoured conciliation and to have mediated in many public and private disputes. His Companions and the first caliphs did the same. The second caliph, ʿUmar b. al-Khaṭṭāb (r. 13-23/634-44) is said to have preferred conciliation to adjudication: «Dispel the disputants until they settle amicably with one another» (Othman, 69). As it is understood in fiqh, ṣulḥ is a form of contract (ʿaqd) consisting of an offer (ījāb) and an acceptance (qubūl). Its object can be material or non-material, but cannot be a prohibited commodity, as confirmed in the following ḥadīth: «Conciliation is permissible except when it makes forbidden that which is permitted and makes permitted that which is forbidden (ḥarām).» Ṣulḥ is both the procedure and the outcome to which it leads. Litigants may agree to compromise outside the scope of the judge’s supervision, but such an agreement would be conditional upon its not being inequitable or contradictory to the principles of Sharīʿa. But ṣulḥ can also be decided by a judge, as in family matters, for instance in divorce, which cannot be finalised without an attempt at reconciling the spouses. The importance of taḥkīm and ṣulḥ varies from one doctrinal school to another. On the whole, the Ḥanafī and Shāfiʿī schools are more amenable to the use of arbitration and conciliation than the Mālikī, which subordinates both to the judge’s supervision (Othman; Hentati). The rise of adjudication in place of conciliation via the various forms of arbitration is a phenomenon that can be observed historically with the rise of the modern state and the increasing influence of legislation. While customary law (ʿurf) is more open to the practice of arbitration and conciliation, civil law has nevertheless proved to be permeable to the influence of custom (Berque; Chelhod; Dupret). Actual cases of arbitration and conciliation are little studied for the pre-twentieth-century period. However, the rise of legal studies focusing on social practices rather than theoretical doctrines has made it possible to observe how these two modes of conflict resolution are developing in the context of contemporary societies. Nowadays, arbitration and conciliation take place inside and/or outside courtrooms, following the principles of civil law, customary law, or Sharīʿa, or a combination of the three. In the Kingdom of Saudi Arabia, for instance, taḥkīm is governed by a special law, which combines the Islamic and Western concepts of arbitration, while ṣulḥ is encouraged by judges and practised in the corridors of the courts, sometimes under the supervision of a board in the Ministry of Justice (Alsheikh, 400). The notion of ṣulḥ has also taken a political dimension within the framework of national reconciliation processes, as in Iraq and Algeria. Moreover, very often reference to Islam recedes to the background, as is the case with commercial arbitration undertaken under the rubric of taḥkīm but in fact following the principles of lex mercatoria (mercantile law). Within courtrooms and especially with respect to family or personal status law (al-aḥwāl al-shakhṣiyya), many national legislations make it obligatory for the judge to appoint conciliators, who must make an attempt to reconcile spouses before the judge can issue a ruling of divorce. For instance, in Egypt, where personal status cases are adjudicated by specialised circuits within the courts, judicial divorce on grounds of harm inflicted falls under Article 6 of Law No. 25 of 1929, which states: «If the wife alleges that the husband mistreated her in such a way as to make it impossible between people of their social standing to continue the marriage relationship, she may request that the judge separate them, whereupon the judge shall grant her an irrevocable divorce if the harm is established and conciliation seems impossible between them. If, however, he [the husband] refuses the petition and she subsequently repeats the complaint without establishing the harm, the judge shall appoint two arbitrators and he shall judge according to the provisions of Articles 7, 8, 9, 10 and 11.» In a similar way, Article 20 of Law No. 1 of 2000 regulating unilateral divorce at the wife’s request (khulʿ) stipulates that the court must not grant a divorce through khulʿ without a prior attempt at reconciliation (muḥāwalat al-ṣulḥ). In case the attempt at conciliation fails, two mediators must be appointed by each party, from among the members of their respective families. They must then try for a maximum period of three months to reconcile the couple (al-ṣulḥ baynahumā). If by that deadline the couple has not reconciled, and if the woman maintains her claim, the judge must dissolve the marriage, even if the husband does not agree (Bernard-Maugiron). Actual reconciliations generally take the form of procedures conducted by specialised institutions accomplishing their task in a bureaucratic way (Dupret, 97). Personal status mediation procedures described for Egypt also hold true in most Muslim contexts, such as in Malaysia (Peletz), Israel (Abou Ramadan), and Sudan (Ben Hounet, «Cent dromadaires»). Outside what transpires in courtrooms, in many Muslim societies one can observe the convening of customary assemblies to adjudicate, formally or informally, in various types of conflicts. This kind of justice co-exists or is intertwined with the state and its institutions. Actually, terms such as customary assemblies (majālis ʿurfiyya), assemblies of Arab men (majālis al-ʿarab), conciliation (ṣulḥ), and arbitration (taḥkīm) refer to a wide variety of conflict-resolution procedures. These are not only linked to surviving tribal structures, as in Yemen (al-ʿAlīmī), but also reach into the domains of family, trade, and even crime, with a dynamic that incorporates state, popular, and customary norms. Often official and unofficial procedures are conducted in parallel by the litigants (Ben Hounet, «La réconciliation»). For instance, a commercial dispute can follow a conciliatory path in accordance with local custom and simultaneously a state-centred judicial one. It must be added that ṣulḥ is most often a very mundane practice for solving mundane disputes. Therefore, it would be misleading to conceive of it as a formalised institution, in that it has only a loose connection, if any, to either fiqh or positive law. It carries the virtuous connotation of ṣulḥ in Arabic, but the shape it takes proves much more contingent and context sensitive (Drieskens). |

| Taḥkīm (1516 слов) (a.), Арбитраж (maṣdar формы II глагол ḥakkama). Ḳur'ān, IV, 35; L’A, xii, 142, sv ḥakama ', T’A, Cairo 1888, viii, 252 ff, Kazimirski, Dictionnaire arabe-français, Paris 1960, i, 470; "Hārūn et alii, al-Mu’djam al-wasīṭ, Cairo 1960, i, 189) ,
Abī Sufyān [q.vv.] I, 384, ст. Б. также al-Ya'ḳūbī, Ta’rīkh, Beirut 1379/1960 ii, 190, al-Ṭabarī, Cairo 1384/1964, iv, 56-8, 66-7, al-Mas'ūdī, Murūdj, ed. Pellat, iii, 145; Ibn Катир, Бидайя, vii, 282 и т. Д.). |
Taḥkīm (1,516 words) (a.), arbitration (the maṣdar of the form II verb ḥakkama . It denotes the action of making an appeal to arbitration by someone involved with another in a conflict or in some affair of a conflicting nature by mutual agreement. It also designates someone fulfilling the role of an agent with the power of attorney, or an authorised agent (with full powers to act) in a different or clear matter. This person should be qualified as a muḥakkam, a person who is solicited for arbitration. The ancient Arabs preferred to use the word ḥakam, arbitrator, from the verb ḥakama, to judge (form I), from which the noun of action is ḥukm or ḥukūma, a decision, verdict or judgement, and in modern Arabic is also used to mean power, government (cf. Ḳurʾān, IV, 35; LʿA , xii, 142, s.v. ḥakama’ , TʿA , Cairo 1888, viii, 252 ff.; Kazimirski, Dictionnaire arabe-français , Paris 1960, i, 470; ʿA. Hārūn et alii, al-Muʿd̲j̲am al-wasīṭ , Cairo 1960, i, 189).
Historically, the term taḥkīm designated the arbitration which took place between the fourth caliph ʿAlī b. Abī Ṭālib and the Umayyad Muʿāwiya b. Abī Sufyān [q.vv.] with the intention of effecting a solution to the grave conflict which had broken out between the two men. The advent of ʿAlī in the year 35/656, following the assassination of ʿUt̲h̲mān, certainly took place under conditions which were, to say the very least, difficult and complex. The new caliph had immediately to confront two opposition movements, contesting his legitimacy and accusing him of being involved, direcdy or indirectly, in the murder of the deceased caliph, and also of protecting the assassins. The first group was led by ʿĀʾis̲h̲a, widow of the Prophet, who nevertheless had been an adversary of ʿUt̲h̲mān during his lifetime, with the support of Zubayr b. al-ʿAwwām and of Ṭalḥa b. ‘Ubayd Allāh, two illustrious companions of the Prophet. The second group was led by the redoubtable Muʿāwiya, with the support of his ally ʿAmr b. al-ʿĀṣ, who was rightly and suitably nicknamed Dāhiyat al-ʿArab, «the supremely shrewd one of the Arabs», by reason of his intelligence and skill in political matters. For the events which followed, involving the Battle of the Camel and the Battle of Ṣiffīn, see ʿalī b. abī ṭālib; al-d̲j̲amal ; ṣiffīn . This last series of skirmishes on the banks of the Euphrates in what is now northeastern Syria in 36-7/656-7 ended with a final and most bloody confrontation on the laylat al-ḥarīr «night ¶ of clamour», Thursday-Friday Ṣafar 37/27-8 July 658. After many exchanges of emissaries and mediators, the two opponents came to an agreement to cease fighting and designated an arbitrator in each camp, hoping thus to bring the conflict to a reasonable solution, following the principles of the Ḳurʾān. ʿAlī in no way wanted this agreement. He wished to continue in combat and to defeat once and for all the forces of his adversary. However, the ḳurrāʾ [q.v.], the readers of the Ḳurʾān, who allegedly numbered some 20,000 men of his army although the number sounds vastly inflated, made him accept the cease-fire. The Syrians easily made their choice; they designated ʿAmr b. al-ʿĀṣ. Then ʿAlī, once more under pressure from the ḳurrāʾ, was constrained to accept as his representative Abū Mūsā al-As̲h̲ʿarī, whom the Arab authors all depict as an honest though naїve man. It seems ʿAlī would have preferred his cousin ʿAbd Allāh b. ʿAbbās or failing that, al-As̲h̲tar. Other voices were again raised in protest among the supporters of ʿAlī, chanting the famous formula lā ḥakama illā llāh, wa-lā ḥukma illā li-llāh, meaning literally «there is no judge but God and there is no acceptable judgement but His». They assembled around ʿAbd Allāh al-Rāsibī and were designated as the muḥakkima al-ūlā , the first group to have proclaimed the spoken formula lā ḥukm a illā li-llāh . It was they who initiated one of the first schismatic movements in Islam, known a little later by the name of K̲h̲awārud̲j̲ [see k̲h̲ārid̲j̲ites ], the dissidents, or those coming from the ranks of the camp of ʿAlī. While awaiting arbitration, the antagonists left Ṣiffīn and returned to their bases, the Umayyads to Damascus and the followers of ʿAlī to Kūfa.
Ibn Muzāḥim al-Minḳarī (d. 212/827), a specialist in ʿAlid affairs and one of the oldest to have devoted a work to the battle of Ṣiffīn (Waḳʿat Ṣiffīn), asserted authoritatively that several poems support this. For him the place in question was well and truly Dūmat al-D̲j̲andal (see Waḳʿat Ṣiffīn, esp. 616-17 and passim; cf. Ibn Abi ’l-Ḥadīd, S̲h̲arḥ , iv, 248-9, 253, 256 and passim; see also al-Yaʿḳūbī, Taʾrīk̲h̲ , Beirut 1379/1960 ii, 190; al-Ṭabarī, Cairo 1384/1964, iv, 56-8, 66-7; al-Masʿūdī, Murūd̲j̲ , ed. Pellat, iii, 145; Ibn Kat̲h̲īr, Bidāya, vii, 282, etc.). Accompanied by eminent men from each camp, the two arbitrators held their first talks. This was a sort of preliminary meeting which led, after numerous attempts, to a treaty drawn up and signed, very ¶ probably on Wednesday, 13 Ṣafar 37 in the same year/31 July 657 (cf. al-Ṭabarī iv, 57; Ibn al-At̲h̲īr, ed. Beirut, iii, 321. While guaranteering the safety of the arbitrators, the text invited the belligerents to observe a truce for one year to comply with the verdict of the arbitration which was based strictly on Ḳurʾānic precepts.
At the end of their work, both arbitrators had each in turn to appear in public and announce their decision, agreed by common assent. ʿAmr feigned a great respect for Abū Mūsā on the pretext that he had been a Companion of the Prophet and was the older man, and he let him speak first. He hastened to pronounce the verdict. ʿAmr followed him to the rostrum, and to the great surprise of all, declared: «As far as I am concerned, I confirm the decision of Abū Mūsā about the demotion of his friend [ʿAlī] but I am supporting mine [Muʿāwiya]». Thus silenced, al-As̲h̲ʿarī set off for Mecca and remained there for the rest of his days. When this news was announced at Kūfa, ʿAlī contested the outcome of the arbitration, considering it contrary to the Ḳurʾān and the sunna . He took the decision to fight Muʿāwiya again, mobilised his forces and left immediately to conquer Syria.
